How Iradium Automobiles Private Limited collects, uses, stores, shares and protects personal data in connection with the Fender Platform.

This Privacy Policy describes how Iradium Automobiles Private Limited ("Company", "we", "us" or "our") collects, uses, stores, shares and protects personal data in connection with Fender, including the website FenderApp.com, Fender web application, mobile applications and related services (collectively, the "Fender Platform"). By accessing or using Fender, you acknowledge that your information will be handled in accordance with this Privacy Policy and applicable law.

1. About Fender

Fender is a garage and workshop management platform designed for automobile workshops, garages, mechanics and their authorised personnel. Fender provides functionality including:

  • Spare-parts and inventory management
  • Purchase and stock records
  • Pickup and drop management

2. Scope of This Privacy Policy

This Privacy Policy applies to personal data processed through FenderApp.com, the Fender web application, Fender Android application, Fender iOS application, Fender administrative systems, customer support, communications relating to Fender, and parts enquiries submitted through Fender.

It applies to workshop owners, employees, mechanics, service advisors, other authorised workshop users and personal data relating to customers or other persons entered into Fender by workshops.

3. Role of the Workshop and Fender

Fender is primarily a business software platform used by independent workshops and garages. When a workshop enters information relating to its customers, employees or vehicles into Fender, the workshop generally determines why that information is being collected and used as part of its business operations. Fender processes such information to provide the software and related services to the workshop.

However, Iradium Automobiles Private Limited may also process certain information for its own legitimate business purposes as described in this Privacy Policy, including operating Fender, securing the platform, providing support, analysing platform usage, improving the service and facilitating spare-parts enquiries and supply through SparesHub. Workshops are responsible for ensuring that they have the necessary authority, consent or other lawful basis to enter personal data into Fender.

Fender is not intended to store full card numbers, banking passwords, UPI PINs or similar authentication credentials.

H. Parts Enquiries to SparesHub

When a user chooses "Submit Enquiry to SparesHub", Fender may process and transmit relevant information including workshop details, workshop contact information, Job Card reference, vehicle make and model, vehicle registration, VIN where available, required part names, part numbers, quantity, description, photographs, urgency and required date.

This information may be used by SparesHub personnel to respond to the parts requirement, provide quotations, check availability and facilitate supply.

5. How We Use Information

Provide Fender

Creating and managing accounts; maintaining customer and vehicle records; creating Job Cards; managing appointments; generating estimates; managing inventory; creating invoices; recording payments; creating Gate Passes; maintaining service history.

Operate Workshop Workflows

Assigning work; tracking repairs; managing vehicle delivery; managing parts requirements; maintaining records; enabling role-based user access.

Facilitate Spare Parts Supply

Fender may analyse workshop-generated parts requirements and operational records to identify parts required for active repair jobs, process enquiries submitted to SparesHub, assist workshops in sourcing parts, provide relevant quotations, understand spare-parts demand, improve availability and fulfilment of spare parts, and provide relevant assistance to participating workshops.

We will not ordinarily use a workshop customer's personal contact information to independently market SparesHub products directly to that customer unless such communication is separately authorised or otherwise permitted under applicable law.

Provide Customer Support

We may access relevant workshop records when necessary to investigate technical problems, resolve support requests, investigate failed synchronisation, restore functionality and investigate security incidents.

Improve Fender

We may use aggregated or appropriately de-identified usage information to understand feature usage, workshop adoption, application performance, errors, product usability, demand patterns and service requirements.

Communicate With Users

We may send account notifications, OTPs, security alerts, product notifications, service updates, appointment-related messages, Job Card updates, estimate communications, invoice communications, support communications and parts enquiry communications.

6. Legal Basis and Lawful Processing

We process personal data only where permitted under applicable law, including based on consent, information voluntarily provided for a specified purpose, processing necessary to provide requested services, compliance with legal obligations and other legitimate uses recognised under applicable law. Where processing is based on consent, the person concerned may withdraw consent in accordance with applicable law. Withdrawal will not affect processing already lawfully carried out before withdrawal.

7. Information Entered by Workshops

Workshop users may enter personal data relating to customers and other individuals into Fender. The workshop is responsible for:

  • Collecting such information lawfully
  • Providing appropriate notices to its customers where required
  • Obtaining consent where required
  • Ensuring information entered is relevant and accurate
  • Responding appropriately to its customers' requests relating to their data
  • Avoiding entry of unnecessary or excessive personal information

Fender should not be used to store sensitive information unrelated to automobile servicing or workshop operations.

8. Access by Fender Administrators

Authorised Iradium Automobiles Private Limited personnel may have administrative access to information stored through Fender for customer support, platform administration, security, fraud prevention, technical troubleshooting, data synchronisation, parts enquiries, compliance, platform analytics and service improvement. Administrative access is intended to be role-based.

9. Sharing of Information

We do not sell personal data to third parties.

Service Providers

We may use service providers for cloud hosting, data storage, email, SMS, WhatsApp-related communications, push notifications, authentication, analytics, error monitoring, customer support, document generation and other technology infrastructure. Such providers may process information only as required to provide their services and subject to applicable contractual and legal requirements.

SparesHub Parts Operations

Information required to process a spare-parts enquiry may be made available to authorised SparesHub sales, sourcing, support and fulfilment personnel.

Legal Requirements

Information may be disclosed where reasonably necessary to comply with applicable law, comply with an order of a court or competent authority, respond to lawful government requests, protect legal rights, investigate fraud, protect the security of Fender, or protect users or other persons.

Corporate Transactions

If the business undergoes a merger, restructuring, acquisition, investment, transfer or sale, relevant information may be transferred subject to applicable law and appropriate safeguards.

10. Data Security

We use reasonable administrative, organisational and technical safeguards including user authentication, OTP authentication, role-based access, access restrictions, session controls, encryption where appropriate, security logging, backup procedures, monitoring and audit controls.

No internet-connected system can be guaranteed to be completely secure. Users should also protect their passwords, OTPs, devices and Fender accounts.

11. Offline Storage and Synchronisation

Fender is designed to continue functioning in areas with weak, intermittent or unavailable internet connectivity. Certain information may temporarily be stored locally on a user's device — Job Cards, customer information, vehicle information, inspection information, parts requirements, notes, photographs, estimates, inventory transactions and other pending records. When connectivity returns, the application may automatically synchronise locally stored records with Fender's servers.

12. Data Retention

We retain personal data only for as long as reasonably necessary for providing Fender, maintaining workshop and service records, supporting users, resolving disputes, preventing fraud, maintaining security, fulfilling contractual obligations, complying with legal and regulatory requirements, and establishing or defending legal claims. Different categories of information may have different retention periods.

13. Account Closure and Data

If a workshop stops using Fender or its account is terminated, information may continue to be retained for a reasonable period for legal, security, backup, fraud prevention, dispute-resolution and record-keeping purposes. Workshop owners should export information they require before permanently closing their accounts.

14. Rights Relating to Personal Data

Subject to applicable law, individuals may have rights concerning their personal data, including the right to:

  • Request information about personal data being processed
  • Request correction of inaccurate information
  • Request completion or updating of information
  • Request erasure where legally applicable
  • Withdraw consent where processing is based on consent
  • Raise a grievance regarding processing
  • Nominate another individual to exercise applicable rights in prescribed circumstances

Some requests concerning data entered by a workshop may need to be directed first to the workshop that collected the information. Requests to Fender may be sent to contact@fenderapp.com. We may request reasonable information to verify identity before processing a request.

15. Grievance Redressal

Questions, privacy requests or complaints concerning Fender may be directed to the Grievance Officer detailed below. We will endeavour to review and respond to legitimate privacy grievances within the period required under applicable law.

16. Cookies and Similar Technologies

FenderApp.com and the Fender web application may use cookies or similar technologies for authentication, maintaining sessions, remembering preferences, security, language selection, application functionality, performance measurement and understanding platform usage. Where consent is legally required for non-essential cookies, appropriate choices will be provided.

17. Communications

Users may receive service-related communications necessary for operating Fender, including OTPs, security notifications, Job Card notifications, estimate notifications, invoice notifications, parts enquiry responses, support messages and important service announcements. Marketing communications, where sent, will be handled in accordance with applicable law and available opt-out mechanisms.

18. Third-Party Links and Services

Fender may contain links to external websites, mapping services, communication platforms or other third-party services. Their privacy practices are governed by their own terms and privacy policies. Iradium Automobiles Private Limited is not responsible for the privacy practices of independent third-party websites or services.

19. International Processing and Transfers

Our service providers may process or store information in India or other jurisdictions. Where personal data is transferred or processed outside India, we will seek to do so in accordance with applicable Indian data-protection requirements and any applicable restrictions on cross-border processing.

20. Children's Privacy

Fender is a business application intended for workshops, garages and authorised business users. It is not intended for use by children or for the intentional collection of children's personal data.

21. Accuracy of Information

Users are responsible for ensuring that information entered into Fender is reasonably accurate and up to date. Fender provides functionality that may allow authorised workshop users to update customer, vehicle and operational records.

22. Data Breaches and Security Incidents

If we become aware of a personal-data breach, we may take actions including investigating the incident, limiting or containing the breach, securing affected systems, restoring data, notifying affected persons where required and notifying competent authorities where required. Any notification will be made in accordance with applicable legal requirements.

23. Changes to this Privacy Policy

We may amend this Privacy Policy from time to time to reflect changes to Fender, changes in technology, changes in our business, new functionality, or changes in law or regulation. The updated Privacy Policy will display a revised effective date. Where a change is material, we may provide additional notice through Fender, email or another appropriate method.

24. Governing Law and Jurisdiction

This Privacy Policy and the use of Fender are governed by the laws of India, subject to applicable data-protection and other statutory rights. Subject to any mandatory statutory forum or remedy available under applicable law, disputes relating to Fender shall be subject to the jurisdiction of the competent courts at Pune, Maharashtra, India.
