Terms of Use
These Terms govern access to and use of Fender, including FenderApp.com, the Fender web and mobile applications and related services.
These Terms of Use ("Terms") govern access to and use of Fender, including the website FenderApp.com, Fender web application, mobile applications and related services (collectively, the "Fender Platform"). The Fender Platform is owned and operated by Iradium Automobiles Private Limited, Pune, Maharashtra, India.
1. About Fender
Fender is a garage and workshop management platform intended primarily for automobile workshops, garages, mechanics, service centres and their authorised personnel. Fender may provide functionality including:
- Customer and vehicle records
- Appointments
- Job Cards
- Vehicle inspections
- Customer complaints and service findings
- Estimates and quotations
- Spare-parts inventory
- Purchases and stock inward
- Parts issue against Job Cards
- Spare-parts enquiries
- Pickup and drop management
- Invoices
- Payment records
- Gate Passes
- Workshop users and roles
- Service history
- Reports and operational information
Fender is a workshop-management tool and is not intended to function as a complete accounting, taxation, ERP, legal, insurance or financial-management system.
2. Eligibility
Fender is intended for business and professional use. You may use Fender only if you are legally capable of entering into a binding agreement, you are authorised to represent the workshop or business registering for Fender, and your use complies with applicable law. Where an employee, mechanic, service advisor, cashier or other user accesses Fender through a workshop account, that user represents that they have been authorised by the workshop to do so.
3. Current Access to Fender
Fender may be offered complimentary to eligible SparesHub customers, on an invitation basis, under promotional programmes, under free plans, under paid plans introduced in the future, or under other eligibility criteria determined by the Company. Complimentary access does not create a permanent entitlement to use Fender without charge. Iradium Automobiles Private Limited may change eligibility criteria, features, usage limits, plan structure, pricing or availability in the future. Where reasonably appropriate, affected users will be informed of material changes before they become applicable.
4. SparesHub Customer Benefit
Fender may currently be made available as an exclusive or complimentary benefit to customers of SparesHub. The Company may verify eligibility using information reasonably available in relation to the workshop's SparesHub business relationship. Access to Fender does not:
- Guarantee availability of any spare part
- Guarantee any particular SparesHub price
- Guarantee credit facilities
- Guarantee delivery timelines
- Create any exclusive purchasing obligation unless separately agreed in writing
Fender and SparesHub are operated under Iradium Automobiles Private Limited.
5. Account Registration
Users may be required to provide information including name, mobile number, email address, workshop name, workshop address, business details, GSTIN (where applicable), user role and other information reasonably required to operate the account. You must provide information that is accurate and reasonably current. You must not create accounts using false identities, impersonate another person or workshop, register a business without authority, share login credentials with unauthorised persons, or circumvent account restrictions.
6. Workshop Administrator
The person registering or designated as the Garage Owner or equivalent administrator may control the workshop account and may add users, assign predefined roles, suspend or deactivate users, configure permitted settings and access records created within the workshop account. The workshop is responsible for determining which employees or authorised persons receive access to Fender. Iradium Automobiles Private Limited is not responsible for unauthorised access caused by a workshop granting inappropriate permissions to its own personnel.
7. User Roles and Permissions
Fender may provide predefined roles including Garage Owner, Branch Manager, Service Advisor, Mechanic, Storekeeper, Purchase Executive, Cashier, Driver, Security / Gate User and Accountant / Auditor. Users must not attempt to access modules outside their authorised role, circumvent permissions, obtain another user's credentials, manipulate role controls or access another workshop's information.
8. Responsibility for Workshop Data
Workshops may enter information relating to customers, vehicles, employees, repair jobs, service history, parts, payments, insurance, estimates, invoices, photographs and other workshop activities. The workshop is responsible for ensuring that such information is lawfully collected, appropriate for workshop operations, reasonably accurate, entered by authorised persons and used in accordance with applicable law. The workshop must obtain any consent, authority or notice required before entering another person's personal information into Fender.
9. Customer and Vehicle Information
Fender allows workshops to maintain customer and vehicle records. The Company does not independently verify customer identity, vehicle ownership, registration details, VIN accuracy, engine-number accuracy, insurance information, odometer readings or other information entered by users. Users are responsible for checking information before relying on it.
10. Job Cards
Job Cards created through Fender are operational workshop records. The workshop is solely responsible for work authorised by the customer, repair decisions, diagnosis, labour performed, parts fitted, pricing, estimated completion dates, vehicle safety, customer communications and final vehicle delivery. Fender merely provides software tools to record and manage these activities.
11. Vehicle Inspections and Photographs
Users may upload photographs and record scratches, dents, damage or other vehicle conditions. Such inspection records are intended to assist workshop documentation. Fender does not warrant that every defect has been recorded, that a photograph conclusively establishes vehicle condition, that inspection diagrams are technically exhaustive, or that inspection data can replace professional mechanical examination. The workshop remains responsible for conducting an appropriate physical inspection.
12. Estimates and Quotations
Fender may generate estimates or quotations based on information entered by workshop users. The workshop is responsible for prices, labour rates, discounts, taxes, parts availability, validity periods, terms and conditions, and customer approval. A Fender-generated estimate does not constitute a price guarantee by Iradium Automobiles Private Limited or SparesHub. Where parts are sourced from SparesHub, the actual SparesHub quotation, availability and commercial terms will apply separately.
13. Spare Parts and Inventory
Fender may provide basic spare-parts and inventory functionality including parts master, stock in hand, reorder levels, purchases, inward, Job Card issue, returns and counter sales. Inventory quantities are based primarily on information entered or recorded by workshop users. Fender does not guarantee that the displayed stock quantity matches the workshop's actual physical inventory. Users should conduct physical verification where necessary.
14. Submit Enquiry to SparesHub
Fender may provide a feature allowing users to select required parts and choose "Submit Enquiry to SparesHub". When used, relevant information may be transmitted to SparesHub, including workshop details, contact information, Job Card reference, vehicle details, registration number, VIN where available, part names, part numbers, quantities, descriptions, required dates and photographs.
15. Information Relating to Parts Demand
Fender may process workshop operational information to identify spare-parts requirements and understand demand patterns. Such information may be used by Iradium Automobiles Private Limited to facilitate spare-parts enquiries, assist workshops with sourcing, understand product demand, improve SparesHub availability, improve Fender functionality, analyse aggregated platform usage and provide relevant business support to workshops. Any personal data processing will remain subject to Fender's Privacy Policy and applicable data-protection requirements. India's current DPDP framework includes the Digital Personal Data Protection Rules, 2025 and associated implementation measures.
16. Invoices and Tax Information
Fender may allow workshops to create GST and Non-GST invoices and calculate applicable taxes based on information entered by the user. Fender is not tax-compliance software. The workshop remains solely responsible for determining whether GST applies, choosing the correct tax treatment, ensuring GSTIN accuracy, invoice numbering, tax rates, tax returns, books of account, e-invoicing obligations where applicable, tax reporting and compliance with tax law. Users should obtain advice from their accountant, Chartered Accountant or tax adviser where necessary.
17. Payments
Fender may allow workshops to record cash payments, UPI payments, card payments, bank transfers, advances, partial payments and credit payments. Unless expressly stated otherwise, Fender merely records payment information entered by the workshop. A payment marked as "Paid" in Fender does not constitute independent confirmation by Iradium Automobiles Private Limited that funds were actually received. The workshop remains responsible for reconciling its payment records.
18. Gate Pass
Fender may generate Gate Passes for vehicle release. A Gate Pass is an operational workshop document only. The workshop is responsible for confirming work completion, customer approval, payment status, vehicle recipient identity, vehicle handover and authority to release the vehicle. Fender does not independently authorise vehicle release.
19. Generated Documents
Fender may generate Job Cards, Estimates, Invoices, Receipts, Gate Passes, Purchase records, Stock documents, Reports and other PDFs or printable records. Users must review generated documents before issuing them. The Company is not responsible for errors resulting from incorrect information entered by the workshop.
20. Offline Operation and Synchronisation
Fender may store certain information locally to support use during weak or unavailable internet connectivity. When connectivity resumes, data may synchronise with Fender servers. Users acknowledge that recently entered data may temporarily remain unsynchronised, information displayed offline may not reflect changes made from another device, stock quantities may be temporarily outdated, conflicting changes may require resolution and some functions may require connectivity. Users should check synchronisation status before relying on time-sensitive information.
21. Backups and Data Loss
We may maintain reasonable backup and recovery processes, but Fender should not be treated as the workshop's only legally required record repository. Workshops should retain independent copies of records where required for taxation, regulatory compliance, insurance, customer disputes, accounting, warranty or other legal purposes. We do not guarantee that every deleted, corrupted or unsynchronised record can be recovered.
22. Acceptable Use
You must not use Fender to violate applicable law, commit fraud, create false invoices or service records, falsify vehicle information, misrepresent repairs, store unlawful content, harass another person, upload malware, attempt unauthorised access, probe or attack Fender infrastructure, circumvent security controls, reverse engineer restricted components, scrape Fender at scale without permission, interfere with other users, use another workshop's account, or copy or commercially exploit Fender software without permission.
23. Prohibited Content
Users must not upload content that is unlawful, infringes intellectual-property rights, contains malware, violates another person's privacy, is fraudulent, is defamatory, is unrelated to legitimate workshop operations or is otherwise harmful to the Fender Platform or its users. We may remove such information and restrict the associated account.
24. Intellectual Property
Fender, including its software, source code, interfaces, designs, logos, branding, databases, workflows, documentation, graphics, website content and application structure, is owned by or licensed to Iradium Automobiles Private Limited and is protected by applicable intellectual-property law. Fender and SparesHub are business identifiers and brands associated with Iradium Automobiles Private Limited. Nothing in these Terms transfers ownership of Fender intellectual property to users.
25. Licence to Use Fender
Subject to these Terms, the Company grants eligible users a limited, non-exclusive, non-transferable and revocable right to access and use Fender for legitimate workshop and business operations. Users may not resell Fender, licence access to unrelated third parties, copy the application, create derivative software from Fender, attempt to obtain source code, remove proprietary notices or commercially exploit Fender without written permission.
26. Ownership of Workshop Data
As between the workshop and the Company, the workshop retains its rights in business information and content it lawfully uploads or creates through Fender, subject to applicable law. The workshop grants Iradium Automobiles Private Limited the rights reasonably necessary to host, store, process, synchronise, display, backup, transmit, analyse and otherwise process such data for operating Fender, providing support, facilitating permitted SparesHub functions and performing the activities described in the Privacy Policy.
27. Aggregated and De-Identified Information
We may generate statistics or analytics derived from Fender usage that do not reasonably identify an individual. Such information may be used for product improvement, business planning, platform analytics, spare-parts demand analysis, market analysis, performance measurement and other legitimate business purposes.
28. Third-Party Services
Fender may rely on third-party providers for services including hosting, email, SMS, WhatsApp communications, maps, authentication, notifications, analytics, cloud storage and other infrastructure. Availability of third-party functionality may depend on those providers. We are not responsible for independent third-party services outside our reasonable control.
29. Links to Third-Party Websites
Fender may contain links to external websites or applications. Accessing an external service is at the user's discretion and may be subject to separate terms and privacy policies.
30. Availability and Changes to Fender
We aim to maintain reliable availability but do not guarantee uninterrupted operation. Fender may occasionally be unavailable due to maintenance, updates, internet failures, hosting failures, third-party outages, security incidents, force majeure events or other technical reasons. We may modify, add, remove or improve Fender functionality from time to time.
31. Beta, New or Experimental Features
Certain functions may occasionally be released in preview, beta or experimental form. Such features may change, contain errors, be withdrawn, have limited support or operate differently from final functionality. Users should not rely on experimental functions for critical operations without independent verification.
32. Support
Fender support may be provided through available channels including email, phone or in-app support. Support availability and response times are not guaranteed unless separately agreed in writing.
33. Suspension of Accounts
We may suspend or restrict a workshop or user account where reasonably necessary because of violation of these Terms, fraud or suspected fraud, misuse, security risk, unauthorised access, illegal activity, abuse of Fender, false registration information, threats to platform integrity, legal or regulatory requirements or loss of eligibility for a restricted programme. Where appropriate, we may provide an opportunity to resolve the issue.
34. Termination
A workshop may stop using Fender at any time. The Company may terminate or discontinue access where permitted by these Terms or applicable law. Upon termination, user access may cease, certain data may remain retained according to the Privacy Policy, outstanding obligations survive, historical records may remain available where legally necessary and users should export information they are required to retain before account closure.
35. No Warranty
To the maximum extent permitted by applicable law, Fender is provided on an "as available" basis. We do not warrant that Fender will always be uninterrupted, every feature will be error-free, every calculation will be correct, all information entered by users is accurate, all data will always synchronise immediately, every parts enquiry will result in supply, or Fender will meet every workshop's specific requirements. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
36. Professional Responsibility
Fender does not provide mechanical diagnosis, automotive engineering advice, legal advice, tax advice, insurance advice, accounting advice or safety certification. Workshop owners and qualified personnel remain responsible for all professional decisions and vehicle repairs.
37. Limitation of Liability
To the maximum extent permitted under applicable law, Iradium Automobiles Private Limited shall not be liable for indirect, incidental, special or consequential losses arising from use of Fender, including loss relating to business interruption, lost profits, incorrect user-entered data, unsynchronised information, incorrect repair decisions, parts availability, customer disputes, tax errors, inventory discrepancies, third-party failures or unauthorised use caused by user credential sharing. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
38. Indemnity
To the extent permitted by law, a workshop agrees to indemnify and hold Iradium Automobiles Private Limited harmless against third-party claims, losses or expenses arising from unlawful use of Fender, data uploaded without authority, workshop services or repairs, misrepresentation to customers, violation of intellectual-property rights, tax or regulatory non-compliance, fraudulent records or material violation of these Terms. This provision does not apply to losses caused solely by the Company's own unlawful conduct.
39. Privacy
Use of Fender is also subject to the Fender Privacy Policy. Users should read the Privacy Policy together with these Terms. The Information Technology Act, 2000 provides India's statutory framework for electronic transactions, and applicable consumer and data-protection laws may also apply depending on the circumstances.
40. Electronic Communications
By using Fender, users agree that service-related communications may be provided electronically, including through email, SMS, in-app notifications, push notifications, and WhatsApp or similar services where enabled. Electronic records and communications may have legal recognition under applicable Indian law.
41. Changes to These Terms
We may update these Terms to reflect changes in Fender functionality, business model, applicable law, security requirements or commercial arrangements. The revised Terms will show an updated effective date. Where changes are material, we may provide reasonable notice through Fender, email or another appropriate method. Continued use after the updated Terms become effective will constitute acceptance to the extent permitted by applicable law.
42. Governing Law
These Terms are governed by the laws of India. The Consumer Protection Act, 2019 and related rules provide statutory consumer protections where they apply; these Terms do not exclude rights that cannot lawfully be waived.
43. Jurisdiction
Subject to any mandatory statutory remedy or forum available under applicable law, courts of competent jurisdiction at Pune, Maharashtra, India shall have exclusive jurisdiction over disputes arising from or relating to Fender or these Terms.
44. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.
45. No Waiver
Failure by the Company to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or any other right.
46. Entire Agreement
These Terms, together with the Fender Privacy Policy and any additional written terms expressly applicable to a particular service or programme, constitute the agreement governing use of Fender. Separate SparesHub purchases remain subject to the commercial terms applicable to those transactions.
